Carlos & Fernanda Dance Institute
Membership Terms and Conditions
These Membership Terms and Conditions apply to all annual membership plans offered by Carlos & Fernanda Dance Institute (“the Institute”), including the Master, Elite, and Prestige Memberships, as well as any future membership category.
By purchasing or activating a membership, the member confirms that they have read, understood, and agreed to these Terms and Conditions.
1. Nature of the Membership
Membership provides access, for a defined period, to a combination of benefits, services, content, events, courses, training programs, mentoring sessions, online materials, communities, discounts, and other opportunities specified in the selected membership plan.
The member is purchasing access to the complete membership program and its benefits as a package. The member is not purchasing each included event, class, mentoring session, video, or benefit separately.
Therefore, no individual monetary value, refund, credit, or compensation will be assigned to a specific benefit that the member does not use.
The exact benefits available depend on the membership category selected by the member. Different membership plans may have different prices, inclusions, eligibility requirements, repetition benefits, and access conditions.
2. Membership Duration, Activation, and Event Validity
Unless expressly stated otherwise, membership is valid for 12 consecutive months.
The membership period begins on the activation date stated in the member’s purchase confirmation. Normally, this will be the date on which the first payment or full payment is successfully received and membership access is activated.
Membership benefits may begin immediately after activation, including access to:

  • Online classes, recordings, or educational materials;

  • Private online groups or communities;

  • WhatsApp or other communication groups;

  • Monthly mentoring or live sessions;

  • Registration opportunities for included events;

  • Member discounts;

  • Support, consultations, or other plan benefits.

Because the membership begins providing access and benefits immediately, the membership cannot ordinarily be cancelled retroactively after activation, except where mandatory law provides otherwise.
To use membership benefits for an event, course, or training, the membership must still be active on the starting date of that activity.
Registering for an activity while the membership is active does not extend the membership period or guarantee free participation in an activity taking place after the membership expiration date.
For example, if a membership is activated on 1 February, it remains valid until 31 January of the following year. An activity beginning in February or March after that expiration date is not covered, even if the member registered for it before their membership expired.
If a registered activity begins after the membership expires, the member must:

  • Renew their membership, when renewal is available; or

  • Pay the applicable individual participation fee.

If neither option is completed by the required deadline, the registration may be automatically cancelled and the place released to another participant.
Events announced far in advance are covered only when their starting date falls within the member’s active 12-month membership period. Early registration does not reserve or extend membership benefits beyond the expiration date.
If a multi-day activity begins while the membership is active, the member may complete that edition even if the membership expires during the activity.
3. Annual Commitment and Payment
The membership is an annual commitment, even when the Institute allows the membership fee to be paid in installments.
Payment in monthly or periodic installments is only a payment facility. It does not convert the membership into a month-to-month subscription.
Once the membership has been purchased and activated, the member remains responsible for paying the entire annual membership fee according to the agreed payment schedule.
Stopping participation, leaving the WhatsApp group, missing events, not accessing online content, or asking to cancel the membership does not cancel the outstanding payment obligation.
If an installment is late or unpaid, the Institute may:

  • Suspend access to membership benefits;

  • Prevent registration for future included events;

  • Remove access to online content or private groups;

  • Cancel existing reservations made through the membership; and

  • Request payment of the outstanding amount.

Suspension or removal of access due to non-payment does not eliminate the member’s responsibility to complete the agreed annual payment.
4. Membership Cancellation and Renewal
A member may request cancellation of any future automatic renewal at any time, subject to the cancellation procedure communicated by the Institute.
Cancellation prevents the membership from renewing for another period. It does not terminate, shorten, or refund the current annual membership period.
After cancelling a future renewal:

  • The current membership remains active until its scheduled expiration date, provided all payments are up to date;

  • All outstanding installments for the current annual term remain payable;

  • No refund will be issued for the remaining months;

  • No unused benefit will be converted into money, credit, or compensation; and

  • The membership will end on its original expiration date.

If the membership does not renew automatically, it will simply expire at the end of the stated membership period unless the member actively purchases a new term.
The applicable renewal conditions will be clearly communicated during registration or purchase.
5. Refund Policy
Except where mandatory law provides otherwise, activated membership fees are non-refundable.
No full, partial, or proportional refund will be provided because the member:

  • Changes their mind;

  • Stops dancing or participating;

  • Moves to another city or country;

  • Experiences changes in employment, family, financial, travel, or personal circumstances;

  • Is unable to attend one or more included events;

  • Does not participate in mentoring or live sessions;

  • Does not watch or use available online content;

  • Leaves or does not participate in the Institute’s online community;

  • Joins after one or more program activities have already taken place;

  • Does not satisfy the level or eligibility requirements of a particular event;

  • Fails to register for an event before its deadline;

  • Cancels an event reservation;

  • Is removed because of inappropriate conduct or violation of these Terms; or

  • Does not use all benefits available under their membership plan.

The Institute does not calculate refunds by dividing the membership price by the number of events, months, classes, mentoring sessions, videos, or other benefits.
Included benefits have no separate refundable cash value and cannot be exchanged for money.
6. Missed Events, Repeated Trainings, and Unused Benefits
The member is responsible for reviewing the Institute’s calendar, announcements, registration deadlines, eligibility requirements, and official communications.
Each member is entitled to one participation in every event, course, or training expressly included in their selected membership plan.
Only membership plans that expressly include repetition allow members to repeat eligible trainings. Under these plans, the member may repeat eligible trainings as many times as they wish during their active 12-month membership period, provided that:

  • The repeated edition begins before the membership expires;

  • The member completes the required free advance registration;

  • Places are available;

  • The member meets the applicable participation requirements; and

  • The training remains eligible for repetition under the selected plan.

The possibility of repeating a training does not guarantee a place in every edition. The Institute also accepts participants who purchase trainings separately, and capacity may be limited.
Members must register within the announced registration period and wait for confirmation when required.
No-Show Policy for Repeated Trainings
Places reserved for repeated participation must be used responsibly. A member who registers to repeat a training but does not attend may prevent another member or paying participant from using that place.
This warning system applies only to repeated participation, beginning with the member’s second registration for the same eligible training.
A no-show means that the member:

  • Registered and received a confirmed place in a repeated training;

  • Did not attend; and

  • Did not cancel the registration before the cancellation deadline communicated by the Institute.

The following system applies:

  • First no-show: First warning;

  • Second no-show: Final warning;

  • Third no-show: Loss of the right to repeat any training for the remainder of the current membership period.

Warnings are cumulative across all repeated trainings and courses. They are not limited to three absences from the same training.
After losing the repetition benefit, the member may still attend any first participation originally included in their plan, provided that their membership remains active and all applicable requirements are met.
Any additional repetition must be purchased separately unless the Institute confirms otherwise in writing.
No refund, reduction, credit, or membership extension will be provided when the repetition benefit is suspended or removed because of repeated no-shows.
If a member cannot attend, they must cancel within the announced deadline so that the Institute can offer the place to another participant. A timely cancellation will not count as a warning.
For all missed activities:

  • No refund or proportional reimbursement will be provided;

  • No cash credit will be created;

  • No automatic membership extension will be provided; and

  • The missed benefit cannot automatically be transferred or exchanged for another service.

When available, the Institute may offer an online recording, future edition, or alternative learning opportunity. Such alternatives are subject to the selected membership plan, availability, capacity, and the member’s active membership period.
7. Events Included in the Membership
Some membership plans include access to selected events, courses, workshops, intensives, training programs, or other activities organized by the Institute.
“Included” means that the applicable participation fee is covered under the membership plan. It does not necessarily include:

  • Flights or other transportation;

  • Accommodation;

  • Meals and drinks;

  • Visas or travel documentation;

  • Travel or medical insurance;

  • Private lessons;

  • Optional tours or excursions;

  • Merchandise;

  • Additional packages or upgrades; or

  • Other expenses not expressly listed as included.

Access may be subject to:

  • Advance registration;

  • Registration deadlines;

  • Limited capacity;

  • Dance-level requirements;

  • Leader and follower balance;

  • Age or health requirements;

  • Partner requirements;

  • Full and timely membership payment;

  • An active membership on the starting date of the activity; and

  • The specific rules of the relevant event.

Membership does not guarantee admission when the member fails to register on time, the activity has reached capacity, the member’s membership will expire before the activity begins, or the member does not meet the stated participation requirements.
8. Relationship with Individual Event Terms
When a member attends an event included in their membership, the specific Terms and Conditions, safety rules, conduct rules, schedules, and participation requirements of that event also apply.
If there is a conflict concerning payment or refunds:

  • These Membership Terms govern the annual membership fee; and

  • The individual event terms govern separately purchased additions, accommodation, upgrades, private lessons, excursions, or other optional services.

An event included through membership is not treated as a separately purchased ticket. Therefore, the refund value of that included event is €0, and the member cannot request part of the annual membership fee back because they did not attend it.
If the member separately purchases an additional event or service that is not included in their membership, the Terms and Conditions applicable to individual purchases will apply to that separate transaction.
9. Changes to Membership Benefits and Calendar
The Institute may make reasonable changes to the membership calendar, dates, schedules, teachers, specialists, venues, delivery formats, content, events, mentoring sessions, and other program elements when necessary.
Changes may result from operational requirements, venue availability, teacher or specialist availability, safety concerns, travel disruption, illness, government restrictions, force majeure, or other circumstances affecting the program.
The Institute may, when reasonably necessary:

  • Reschedule an included event or session;

  • Replace a teacher, mentor, specialist, venue, or activity;

  • Change an in-person activity to an online or hybrid format;

  • Provide recordings or alternative learning content;

  • Replace an included event with a reasonably comparable activity; or

  • Move an activity to a later date.

The Institute will make reasonable efforts to maintain the overall value and educational purpose of each membership plan.
A change to one event, date, teacher, venue, or individual benefit does not automatically entitle the member to cancel or receive a refund for the entire membership.
If an activity is rescheduled to a date after the member’s original membership expiration date, the Institute will inform the member whether the original registration remains valid or whether an alternative arrangement will be offered.
Nothing in this section limits rights that cannot legally be excluded under applicable consumer law.
10. Membership Tiers, Upgrades, and Downgrades
Each membership tier includes only the benefits officially listed for that plan at the time of purchase, together with any additional benefits subsequently granted by the Institute.
The Institute may allow a member to upgrade to a higher plan by paying the applicable price difference.
Unless the Institute expressly approves otherwise in writing:

  • Upgrades do not restart the original 12-month membership period;

  • Downgrades are not available during the current annual term;

  • A lower membership tier may be selected only for a future renewal; and

  • No refund or credit will be provided when changing to a lower plan.

Promotional bonuses and complimentary benefits have no cash value and cannot be refunded, exchanged, or transferred.
11. Personal and Non-Transferable Membership
Membership is personal and may be used only by the registered member.
Login details, recordings, links, documents, teaching materials, discounts, event access, and other membership benefits may not be shared, resold, copied, transferred, published, or distributed without written authorization from the Institute.
The annual membership itself cannot be transferred to another person unless the Institute expressly approves the transfer in writing. An administrative transfer fee and eligibility requirements may apply.
12. Recordings and Intellectual Property
Videos, recordings, teaching methods, class materials, documents, choreography, course structures, and other educational content provided through the membership remain the intellectual property of the Institute or the relevant content owner.
The member receives a personal, limited, non-exclusive, and non-transferable right to access the materials during the applicable access period.
The member may not:

  • Share login credentials;

  • Download content unless expressly permitted;

  • Record restricted sessions;

  • Reproduce or distribute materials;

  • Use the materials to create or resell another course;

  • Publish the materials online; or

  • Use the Institute’s name, certification, or branding without authorization.

Access may end when the membership expires, even if particular materials were made available earlier during the membership period.
13. Community Conduct
Members must behave respectfully toward teachers, mentors, staff, guests, and other members.
Harassment, discrimination, threats, unsafe behavior, unauthorized advertising, sharing of private information, distribution of membership content, or serious disruption of the community may result in suspension or termination of membership.
When membership is terminated because of the member’s misconduct or violation of these Terms:

  • No refund will be provided;

  • Outstanding annual payments remain payable; and

  • The member may lose access to events, groups, recordings, and all other benefits.

14. Health, Safety, and Personal Responsibility
Participation in dance and physical activities involves inherent risks. Each member is responsible for assessing their health and ability to participate safely.
Members must follow safety instructions, disclose relevant physical limitations when appropriate, stop participating if they experience pain or illness, and maintain suitable health, accident, travel, and personal liability insurance.
The Institute is not responsible for injuries, losses, or damages resulting from inherent activity risks, a member’s medical condition, inappropriate conduct, failure to follow instructions, or the actions of other participants or third parties.
Each member is also responsible for:

  • Their personal belongings;

  • Any loss, theft, or damage involving their belongings;

  • Any injury or damage they cause to another person;

  • Any damage they cause to a venue, hotel, studio, equipment, accommodation, or other property; and

  • Any resulting repair, replacement, cleaning, legal, or financial costs caused by their actions.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
15. Immediate Activation and Statutory Withdrawal Rights
Where applicable law grants a consumer a statutory withdrawal period for an online purchase, those mandatory rights remain applicable.
By purchasing the membership and accepting these Terms and Conditions, the member expressly requests and consents to the immediate activation of the membership before the end of any applicable statutory withdrawal period.
The member understands that immediately after payment or activation, the Institute may begin providing membership benefits, including:

  • Access to digital content, videos, recordings, and educational materials;

  • Access to online platforms, private communities, and WhatsApp groups;

  • Live or recorded classes and mentoring sessions;

  • Consultations, support, and communication with the Institute;

  • Membership discounts and special offers;

  • Registration opportunities and reserved access to included events; and

  • Any other services or benefits included in the selected membership plan.

The member expressly acknowledges that:

  • For digital content supplied immediately, the statutory right of withdrawal may be lost once access or delivery begins, where permitted by applicable law;

  • For services that begin immediately, if a statutory withdrawal right remains applicable, the Institute may deduct the proportionate value of all services, access, benefits, reservations, and content supplied before receiving the withdrawal request; and

  • After the applicable statutory withdrawal period has expired, the Institute’s standard non-refundable membership policy applies.

The member understands that simply failing to use the membership does not mean that the service was not made available or provided. Access to content, communities, event registration, mentoring, discounts, and other membership opportunities constitutes part of the membership service, whether or not the member actively uses each benefit.
Nothing in these Terms excludes or limits any consumer right that cannot legally be waived.
16. Final Consent and Acknowledgment
By selecting the mandatory acceptance checkbox and completing the purchase, the member expressly confirms that they:

  • Have read, understood, and agreed to these Membership Terms and Conditions;

  • Are purchasing a 12-month membership package and not separate tickets for each event, class, mentoring session, or benefit;

  • Understand that included activities must begin during their active membership period;

  • Understand that registering early does not extend their benefits beyond the membership expiration date;

  • Understand that installment payments are only a payment facility for the total annual commitment;

  • Understand that the annual payment obligation continues even if they stop participating;

  • Understand that cancelling the membership affects only a future renewal and does not cancel or refund the current annual term;

  • Understand that missed or unused benefits have no separate monetary or refundable value;

  • Understand the registration and no-show rules applicable to repeated trainings;

  • Accept responsibility for reviewing event dates, registration deadlines, participation requirements, and official Institute communications;

  • Expressly request and consent to the immediate activation of the membership;

  • Expressly request the immediate supply of digital content, online access, community access, mentoring, registration opportunities, and other available membership services;

  • Acknowledge that immediate delivery may affect or end their statutory right of withdrawal, to the extent permitted by applicable law; and

  • Agree to the specific rules and Terms and Conditions applicable to any event they attend.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
These Terms are subject to all mandatory consumer rights and protections established by applicable law.
